Terms of Use

NASH Co., Ltd. (hereinafter referred to as “the Company”) hereby establishes the following Terms of Use (hereinafter referred to as “these Terms”) regarding the tours, reservation services, website, and other services provided through “Miyakojima ADVENTURE PiPi,” which is operated by the Company.

Article 1 (Application)

These Terms and Conditions apply to the relationship between the Company and users regarding the use of the Miyakojima ADVENTURE PiPi website operated by the Company, its reservation services, various activities and tours, RCS, SMS, MMS, email, and other messaging services (hereinafter collectively referred to as “the Services”).

When using this Service or making a reservation, users shall review these Terms of Service and the conditions set forth on the respective tour and plan pages, and shall use this Service only after agreeing to them.

If specific terms, precautions, eligibility requirements, cancellation policies, or other provisions are set forth on individual tour or plan pages, such provisions shall also constitute part of these Terms and Conditions.

In the event of any conflict between these Terms and any specific provisions, the specific provisions shall take precedence.

Reservation sites operated by third parties, travel agencies, sales agents, or other affiliated sales providers (hereinafter referred to as “Affiliated Sales Sites, etc.”), the terms and conditions established by such Affiliated Sales Sites, etc. shall take precedence with respect to the application, confirmation, modification, cancellation, and handling of cancellation fees for such reservations; these Terms and Conditions shall apply only to the extent they do not conflict with those terms and conditions.

Article 2 (Reservation Requests and Confirmation)

  1. Users shall apply to make reservations for tours and other services using the method specified by the Company.
  2. Users shall provide accurate and up-to-date information regarding their name, phone number, email address, number of participants, and any other information required by the Company at the time of booking.
  3. A reservation shall be deemed to have been made at the time our company or the reservation system we use sends a confirmation notice to the user. However, if a reservation is made through a partner sales site or similar platform, the time at which the reservation is deemed to have been made shall be determined in accordance with the terms and conditions of that partner sales site or similar platform.
  4. We may be unable to accept your reservation due to the tour being fully booked, minimum participation requirements, safety concerns, or other unavoidable circumstances.
  5. Minors must obtain the consent of a parent or other legal guardian before making a reservation.

Article 3 (Reservations and Participants)

  1. If a user makes a reservation on behalf of multiple participants, that user (hereinafter referred to as the “Reserver”) is deemed to have the necessary authority to submit the reservation on behalf of the participants.
  2. The person making the reservation shall ensure that each participant is made aware in advance of these Terms and Conditions, the participation requirements, precautions, cancellation policies, and any other conditions provided by the Company, and shall submit the reservation only after obtaining the necessary consent.
  3. The person making the reservation shall provide accurate information regarding the participants’ ages, health conditions, and any other information we require to determine their eligibility to participate in the tour.
  4. With regard to participants, those provisions of these Terms and Conditions that, by their nature, apply to participants shall apply.

Article 4 (Usage Fees and Payment)

  1. The usage fees for this service shall be the amounts displayed on the respective tour and plan pages, etc.
  2. Payment methods and due dates shall be as specified on each tour and plan page or as indicated at the time of booking.
  3. Internet connection fees, communication charges, and any other costs necessary to use this service shall be borne by the user.

Article 5 (Reservation Changes and Cancellations)

  1. The cancellation policies listed on each tour and plan page apply to changes or cancellations made by customers.
  2. Depending on the timing of the cancellation and other conditions specified on each tour or plan page, a prescribed cancellation fee may apply. However, this does not apply if otherwise provided by law.
  3. In the event of repeated no-shows, fraudulent reservations, or any other conduct that interferes with the proper operation of this service, we may refuse future reservations or use of this service.

Article 6 (Tour Changes and Cancellations)

In the event that we determine that it is difficult to conduct a tour safely due to weather, sea conditions, river conditions, natural disasters, typhoons, transportation service suspensions, facility closures, or other reasons, we may change the tour details, location, or schedule, or cancel the tour.

If we cancel the entire tour, we will refund the tour fees already paid by the customer. However, if there are specific provisions regarding the eligibility for refunds and the refund method, we will comply with those provisions.

With regard to the handling of fees when a tour is conducted with modifications to part of the itinerary, such handling shall be in accordance with the terms and conditions of each plan, taking into account the nature of the changes and other relevant circumstances.

Article 7 (Participation Requirements and Safety Management)

  1. Users and participants shall ensure that they meet the age, health, physical fitness, and other participation requirements specified for each tour before participating.
  2. We may refuse participation to pregnant women, individuals with pre-existing medical conditions, those concerned about their health, individuals who have been drinking alcohol, or anyone else whom we reasonably determine cannot participate safely.
  3. Users and participants must follow the safety instructions given by our staff and guides during the tour.
  4. If a user or participant fails to follow safety instructions, we may refuse to allow them to participate in or continue the tour.
  5. Regarding the participation of minors, parental consent must be obtained as necessary, in accordance with the conditions specified for each plan.

Article 8 (Prohibited Acts)

Users and participants must not engage in the following actions when using this Service.

  1. The act of registering or reporting false or inaccurate information
  2. Impersonating another person to make a reservation or use this service
  3. Any conduct that causes inconvenience, disadvantage, or harm to our company, other users, participants, or third parties
  4. Violence, verbal abuse, intimidation, harassment, or other inappropriate behavior toward our staff, guides, or other participants
  5. Deliberately failing to follow safety instructions given by our staff or guides
  6. Acts that interfere with the operation of this service
  7. Unauthorized access to websites, reservation systems, and other systems, or any other actions that place an excessive load on the system
  8. Any unauthorized use, reproduction, or copying of our images, text, logos, or other content
  9. Acts that violate laws or public order and morals
  10. In addition, any conduct that we reasonably determine to be inappropriate in light of the intent of these Terms or the proper operation of the Service

Article 9 (Responsibilities of Users, etc.)

  1. If a user or participant violates these Terms of Service or causes damage to the Company or a third party through willful misconduct or negligence, such user or participant shall be liable to compensate for such damage in accordance with applicable laws and regulations.
  2. The same shall apply in cases where a user or participant intentionally or through negligence damages, soils, or loses any facilities, vehicles, vessels, activity equipment, or other items owned or managed by the Company.

Article 10 (Communication via RCS, SMS, Email, etc.)

We may use the phone numbers, email addresses, and other contact information we have collected from users to contact them via RCS, SMS, MMS, email, or other means for the following purposes.

  1. Reservation Requests and Confirmation of Reservation Details
  2. Information necessary for participating in the tour, such as the meeting time, meeting place, and tour status
  3. Information on Resuming a Reservation If the Reservation Process Has Not Been Completed
  4. Information Regarding Reservation Changes, Cancellations, and Tour Cancellations
  5. Response to Your Inquiry
  6. Information about our products, services, promotions, benefits, and more
  7. Other communications necessary for the provision of this service

Messages intended for sales promotion, such as advertisements and campaigns, will be sent only to the extent that we have obtained the necessary consent from users.

Users may request to opt out of receiving promotional messages by following the instructions provided by the Company.

Even after you have opted out of receiving promotional messages, we may still send you communications regarding confirmed reservations, tour status, meeting instructions, important notices, and other information necessary for the provision of this service.

In connection with the provision of services such as RCS, Google, other messaging providers, telecommunications carriers, and similar entities may process phone numbers, message content, and other information to the extent necessary for sending and receiving messages.

Article 11 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights related to the text, images, videos, photographs, logos, designs, and other content posted on this service and our website belong to our company or to third parties who hold legitimate rights thereto.

Except as permitted by law, users may not use, reproduce, reprint, modify, distribute, or otherwise handle these materials without our permission.

Article 12 (Photos and Videos Taken During the Tour)

We may take photos or videos during the tour and provide them to participants.

In addition, based on the terms to which you agreed when participating in the tour, we may use the photos or videos we take on our website, social media, in advertisements, and for other public relations and sales promotion activities.

The purpose, scope, and other conditions regarding the use of photos or videos shall be governed by the terms of consent provided at the time of participating in the tour.

Article 13 (Disclaimer)

  1. While we provide this service with due consideration for safety, users and participants are expected to participate with the understanding that activities conducted in natural environments involve a certain degree of risk.
  2. The provision of this service may be delayed, changed, or suspended due to weather, sea conditions, natural disasters, typhoons, suspension of public transportation, facility closures, communication failures, or other reasons beyond our reasonable control.
  3. If the user incurs transportation, lodging, or other incidental expenses due to a tour delay, change, or cancellation resulting from the reasons stated in the preceding paragraph, the Company will not be responsible for such expenses, unless the Company acted with intent or negligence.
  4. The Company shall not be liable for any damages arising from the willful misconduct or negligence of the user or participant, failure to follow safety instructions given by our staff or guides, or any other cause attributable to the user or participant.
  5. In the event that a user or participant suffers financial loss due to our slight negligence (meaning negligence other than gross negligence), our liability for damages shall be limited to an amount not exceeding the tour fee for the relevant tour and shall be confined to the scope of damages that would ordinarily be incurred.
  6. The provisions of the preceding paragraph shall not apply in cases of willful misconduct or gross negligence on the part of the Company. In such cases, the Company shall be liable in accordance with applicable laws and regulations.

Article 14 (Handling of Personal Information)

The handling of personal information and other information regarding users and participants shall be governed by our “Privacy Policy,” which is separately established by our company.

Article 15 (Exclusion of Antisocial Forces)

  1. Users and participants must not be members of organized crime groups, members of organized crime groups, associate members of organized crime groups, companies affiliated with organized crime groups, corporate extortionists, thugs posing as social activists, specialized intelligence-based violent groups, or any other entities equivalent thereto (hereinafter referred to as “Antisocial Forces”), and that they do not have any socially reprehensible relationships with Antisocial Forces.
  2. If it is determined that a user or participant has violated the preceding paragraph, the Company may immediately cancel the reservation or refuse participation in the tour without any prior notice or other procedures.
  3. If a reservation is canceled in accordance with the preceding paragraph, the Company shall not be liable for any damages incurred by the user or participant as a result.

Article 16 (Changes to the Service and These Terms)

We may modify the content of this service to the extent permitted by law.

We may amend these Terms if such amendments are in the best interests of users, or if they do not conflict with the purpose of these Terms and are reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other relevant circumstances.

If we make any changes to these Terms, we will notify users of the details of the changes and the effective date by posting them on our website or through other appropriate means.

Article 17 (Severability)

Even if any provision or part thereof of these Terms and Conditions is deemed invalid or unenforceable under the Consumer Contract Act or any other laws or regulations, the remaining provisions of these Terms and Conditions and the remaining parts of such provision shall remain in full force and effect.

Article 18 (Assignment of Rights and Obligations, etc.)

  1. The User shall not, without our prior written consent, assign, transfer, or pledge to a third party the User’s contractual status under these Terms and Conditions, or the rights and obligations arising therefrom.
  2. If we transfer the business related to this Service to a third party, we may, in connection with such business transfer, assign our contractual status, rights, and obligations under these Terms, as well as user information, to the transferee, and the user hereby agrees to this in advance.

Article 19 (Governing Law and Jurisdiction)

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

In the event of a dispute arising between the Company and a user or participant regarding this Service, unless otherwise provided by law, the court with jurisdiction over the location of the Company’s head office shall be the non-exclusive agreed-upon court of first instance.

Article 20 (Language)

The Japanese version of these Terms shall be the official version. In the event of any discrepancy between the Japanese version and any translated versions in English, Korean, Chinese, or other languages provided by the Company for reference purposes, the Japanese version shall take precedence.
